Manufacturer Warranty & Non-Affiliation


We are an independent, third-party Repair Center and we are not affiliated with Apple, Microsoft, Creative Labs, or any other manufacturer or company. ANY REPAIRS WE PERFORM ON YOUR DEVICE WILL VOID YOUR MANUFACTURER WARRANTY, IF IT IS STILL ACTIVE. We recommend that you attempt to have your device repaired under the active manufacturer warranty, or under any extended warranty programs you may have purchased, before attempting repairs through our company. By purchasing anything from our website, you are agreeing to these terms.

"Apple," "Microsoft," "Creative Labs," and names such as "iPod," "Zune," and "Zen" are trademarked by their respective companies/owners, and are used here for reference only.


Free Testing Service

What is Free Testing?

Free Testing is a service that includes complete testing of your device to see what is not working and what is working. The Gadget Doctor will call or email you upon completion of the testing to notify you of what is working and what is not working, and how much it will cost to repair it. You are not charged for Free Testing. Upon notification of what is wrong with your device, you can then decline or authorize repairs. If you authorize repairs, you may purchase repair services and your device will be mailed back to you. If you decline repairs, your device will be mailed back to you for free; we pay for return shipping of your device.

Terms of Free Testing:

By sending in your device(s) for Free Testing, you agree to EITHER have your gadget repaired by The Gadget Doctor, OR decline repairs and have your device sent back to you without repairs. You also agree not to a) purchase parts from The Gadget Doctor to do the repair yourself without paying the $29.99 repair-declination fee, or b) purchase parts from another company to do the repair yourself.

You are expected to review the Repair Prices offered by The Gadget Doctor before sending in your device for Free Testing. If you have reviewed the prices and believe they are too high, do not send in your device for Free Testing. Prices at the Gadget Doctor are not negotiable and 99.9% of our customers are happy with our prices.

Abuse of Free Testing:

To prevent abuse of our Free Testing service, we will charge you a $29.99 repair-declination fee if you decline repairs and decide to purchase a part and do the repair yourself.

Examples of abuse:

1. If you send in your device for Free Testing, and receive an email or call from us letting you know what is broken and what part you need to have replaced, and then you decide to purchase the part and do the repair yourself, we will sell you the part as long as you are willing to pay the $29.99 repair-declination fee. If you register a different account, have someone else purchase the part(s) for you, or otherwise disguise your identity to evade the $29.99 repair-declination fee, and purchase the parts, you are violating the terms of our website and our services, and we will ban you from the site. In addition, we may also take legal action against you.

2. If you send in a device or multiple devices for Free Testing, then decline repairs and purchase parts from us or another company to complete the repairs yourself and you do not pay the $29.99 declination fee, you have violated the policies of our website and you will be banned from the site and legal action may be taken against you.

The proper manner in which to use our Free Diagnostic Testing service is to:
1. Decide to purchase repair services, or
2. Decline repairs and do not purchase parts from us or any other company after you have had your device tested.



Payment


We accept credit and debit card payments via Visa and Mastercard. We also accept PayPal.



Shipping

From your address to our address
 
You are responsible for delivery of your package to our address and you agree to release us of any liability should your package become lost in the mail or not make it to our address. This includes the USPS "delivery confirmation" tracking number showing the package as having been delivered, but the package failing to be found by us. On rare occasions the package is delivered to the wrong address number on the same street, or a different street altogether within the same zip code where we are located.

From our address to your address

We ship all over the world. We use USPS exclusively. Insurance is mandatory on all USPS shipments above $200. An adult signature is required on most deliveries above $200. Please make sure that the address in your account is the same address where you will be available to sign for the package when it arrives.

Customs, duties and taxes involved with shipping outside the United States are not included in the shipping cost and are the responsibility of the customer. You agree that, if your package is returned to us due to VAT, customers or other taxes being unpaid, you understand that we are charged a large fee to accept your package back into the United States, and therefore we are not obligated to refund your order.



Returns & Rework

Used, New & Refurbished Gadgets, Parts & Accessories:

We allow returns on most items. However, returns for new, used or refurbished items that are not defective will be charged a 15% restocking fee. Returns of items that are defective will receive a full refund of the item price but not the shipping or return shipping. If you damage the item, you are liable and we reserve the right to give a partial or no refund. Returns must be received within 30 days receipt of the item. There are no returns after 30 days.

Gadgets That Have Experienced Repair Services:

We allow returns for rework on all gadgets that have been repaired by our company. The gadget must be returned within the 90-day warranty period. There are no reworks/returns after 90 days. Our 90-day warranty only covers the specific part or parts that we replaced during the initial repair, and the labor to replace them again should they break under warranty. In addition, our 90-day warranty only covers parts that fail naturally. We reserve the right not to warranty certain parts or gadgets. Examples of parts or gadgets we will not warranty:
-    The gadget was opened or tampered with by the customer
-    There was accidental damage done from dropping, spilling soft drinks on the device, and so forth

If you return your gadget for rework within the 90 day period, and, upon examination and testing, we discover that it is fully functional and passes all tests, there will be a $10 shipping fee to return the device*. If you return the gadget to us, and it is discovered to be experiencing the problem it was repaired for, we will return it to you for free upon repair. If we test it and discover that it is experiencing a problem unrelated to the initial repair, we will offer you several options including refund of the initial repair, buy-back of your device, etc.

By using our services, you agree that our judgment as to the condition or repair status of your device is final. For example, if we state that it has been repaired but you disagree, then you agree not to seek refund, exchange, further warranty services, or legal action against our company. We are electronics technicians who have repaired thousands of devices; you agree that you are not qualified to judge whether your device is supposed to perform specific functions under specific conditions.

*Most of the time, when the customer receives the device back after repairs, when it does not connect/sync to the customer's computer, it is their computer's fault and not the fault of the gadget. When the customer sends it back for rework, 99% of the time it syncs to our computers immediately and passes all tests.

Unclaimed or Rejected packages:

Due to extra fees charged to us to receive unclaimed packages, as well as time and handling to process the package, sort the item(s) and put them back into inventory, we reserve the right to give a partial or no refund on unclaimed or rejected packages. By purchasing any item on our website, you agree to these terms.



Abandoned Orders

If you ordered FREE Testing, we will send you an email with the results of our testing. This email will include a price estimate for completion of the repairs (such as parts, repairs charges, and/or return shipping) and instructions on how to order the specified repair services. If you do not follow up via email with a solid decision to either authorize or reject repairs, and/or if you fail to pay for repairs within 30 days of receipt of the item at our Repair Center, your gadget will be considered an "Abandoned Order," and we will hold your gadget for the 30 day period. After the 30 day period, we reserve the right to dispose of or salvage your gadget for parts. You agree not to seek reimbursement for the value of your gadget or for services already rendered to your gadget.

If you cannot reach us through email, we recommend that you call us.

This section does not apply to "Complete Orders" -- purchases made for both service and parts. Complete orders will be automatically completed at the Repair Center.



In-House Shipping Insurance

For all items priced between $200 and $400, you will be required to pay a small fee for insurance depending on the price of the item. This fee is included in the shipping cost. These small insurance fees are pooled together in our Shipping Insurance Account. If you receive your item in the mail damaged, we ask that you return the item ASAP for examination and testing. We will then decide to repair the item, or send you a refund or exchange.

If your item becomes lost in the mail (in route from our address to your address) we will allow for at least 10 days but no more than 30 days before sending you a replacement. This is to allow time for the package to be found and delivered by the Carrier. You agree to wait for up to 30 days before the replacement is shipped to you. You may not ask for a refund during the 10-30 day waiting period.

For items priced at or above $400, you will pay the actual cost of the Carrier's shipping insurance. In the case of damage during shipping, you will be required to file a claim through the Carrier and wait up to 60 days or the time required by the Carrier to process the claim and receive your refund.

We are not responsible for shipping damages for items priced at or above $400; you agree to release us of any liability in the case of shipping damage for items priced at or above $400, and you agree to be bound by the final decision of the Carrier.



In-House Extended Warranties:

You may purchase an extended 2-year warranty on select new, used or refurbished items and repaired devices.


 
Privacy Policy

 The Gadget Doctor is committed to protecting your privacy. We may occasionally collect personally identifiable information with our shopping cart. Our site does use cookies to track visitors in the shopping area.  The Gadget Doctor does not sell, trade, or rent your personal information to others. In Summary, We are committed to protecting your privacy. We use the information we collect on the site to make shopping at  The Gadget Doctor possible and to enhance your overall shopping experience. We do not sell, trade, or rent your personal information to others.



Terms and Conditions

1. You should assume that everything you see or read on the Site is copyrighted unless otherwise noted, and may not be used except as provided in these Terms and Conditions without the written permission of  The Gadget Doctor.  The Gadget Doctor neither warrants nor represents that your use of materials displayed on the Site will not infringe rights of third parties not owned by or affiliated with  The Gadget Doctor.

2. While  The Gadget Doctor uses reasonable efforts to include accurate and up to date information in the Site,  The Gadget Doctor makes no warranties or representations as to its accuracy.  The Gadget Doctor assumes no liability or responsibility for any errors or omissions in the content of the Site.

3. Neither  The Gadget Doctor nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Site. Without limiting the foregoing, everything on the Site is provided to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties.  The Gadget Doctor also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video, or audio from the Site.

4. Images of people or places displayed on the Site are either the property of, or used with permission by,  The Gadget Doctor. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms and Conditions or specific permission provided elsewhere on the Site. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

5. The trademarks, logos, and service marks (collectively the "Trademarks") displayed on the Site are registered and unregistered Trademarks of  The Gadget Doctor and others. Nothing contained on the Site should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of  The Gadget Doctor or such third party that may own the Trademarks displayed on the Site. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms and Conditions, is strictly prohibited.

6.  The Gadget Doctor has not reviewed all of the websites linked to the Site and is not responsible for the content of any off-Site pages or any other websites linked to the Site. Your linking to any other off-Site pages or other websites is at your own risk.

7. While we are always happy to hear from you, it is  The Gadget Doctor policy not to accept or consider creative materials, ideas, or suggestions other than those we specifically request. This is to avoid any misunderstandings if your ideas are similar to those we have developed independently. Therefore we must request that you do not send to us any original creative materials such as original artwork, written works, etc. Any communication or material you do transmit to the Site by electronic mail or otherwise will be treated as non-confidential and non-proprietary.  The Gadget Doctor or its affiliates may use anything you transmit or post for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore,  The Gadget Doctor is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information.

8. You agree to indemnify, defend and hold  The Gadget Doctor and its affiliates, and their respective officers, directors, owners, agents, information providers and licensors (collectively, the "Indemnified Parties") harmless from and against any and all claims, liability, losses, costs and expenses (including attorneys' fees) incurred by any Indemnified Party in connection with any breach by you of these Terms and Conditions.  The Gadget Doctor reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with The Gadget Doctor's defense of such claim. You agree not to engage in legal action against The Gadget Doctor, and that any legal matters must be settled by arbitration.

9. By using this Site, you agree to hold The Gadget Doctor harmless from, and you agree not to sue The Gadget Doctor for any claims related to the use of this web site or our services, or purchase of our parts or services. You agree to use arbitration to resolve any disputes. You agree that any award in an arbitration shall be limited to monetary damages and shall include no injunction or direction to any party other than the direction to pay a monetary amount. Further, the arbitrator(s) shall have no authority to award punitive, consequential or other damages not measured by the prevailing party's actual damages in any arbitration initiated under this section, except as may be required by statute.

10. The Site is controlled and operated by  The Gadget Doctor.  The Gadget Doctor makes no representation that materials in the Site are appropriate or available for use in locations and countries outside of our business location. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing, signed by  The Gadget Doctor.

11.  The Gadget Doctor does not participate in the Better Business Bureau programs or rating systems. Because we are not participating*, we will inevitably and automatically receive a "bad grade."  We consider the grade given to The Gadget Doctor by the BBB to be invalid and not a reflection upon our business practices, but rather a reflection on the fact that a very small percentage of our customers cannot be satisfied by reasonable means. By purchasing anything from our website, or by using any of our services, you agree to these terms.

*"Participate" is defined as paying all fees the BBB charges for membership, and responding to all claims ongoing until the matter is resolved.
